The terms and conditions that govern our web design subscription service.

Please read these Terms of Service ("Terms") carefully before using the services provided by Austin Munday WebDev ("we," "us," or "our"). By engaging our services, you ("Client," "you," or "your") agree to be bound by these Terms.

Service Description

Austin Munday WebDev provides a subscription-based web design service for small businesses in Central Florida. Our standard service includes:

  • A professionally designed, mobile-responsive website
  • On-site drone photography and/or videography for your business
  • Website hosting and maintenance
  • SSL certificate for secure browsing
  • Basic search engine optimization (SEO)
  • Ongoing content updates and support

All of the above is provided for $60 per month with no setup fees or upfront costs.

Payment Terms

Monthly Subscription

  • The subscription fee is $60 per month, billed monthly.
  • Payment is due on the same day each month as your initial sign-up date.
  • We accept major credit cards, debit cards, and ACH bank transfers.
  • There are no setup fees, design fees, or hidden charges.

Late Payments

  • If payment is not received within 7 days of the due date, we will send a reminder notice.
  • If payment is not received within 14 days, your website may be temporarily taken offline until payment is made.
  • Continued non-payment for 30 days or more may result in cancellation of your service and removal of your website.

Website Ownership and Content

Website Design and Code

While your subscription is active, you have full use of your website. However, the underlying website design, code, and structure remain the property of Austin Munday WebDev. If you cancel your subscription, the website will be taken offline.

Your Content

You retain full ownership of any content you provide to us, including but not limited to:

  • Business information, logos, and branding materials
  • Text and copy you supply for the website
  • Photos or images you provide (excluding drone content)

Drone Photography and Videography

Drone photos and videos captured by Austin Munday WebDev during on-site visits are the property of Austin Munday WebDev. You are granted a non-exclusive license to use these images for your business while your subscription is active. Upon request and at our discretion, we may provide copies of drone media for your use outside the website.

Cancellation Policy

  • You may cancel your subscription at any time with no cancellation fees or penalties.
  • To cancel, contact us by phone at (863) 529-3611 or by email at austindmunday@gmail.com.
  • Upon cancellation, your website will remain active until the end of your current billing period.
  • After cancellation takes effect, your website will be taken offline and the domain may be released.
  • We can provide an export of your content (text, your supplied images) upon request at the time of cancellation.

Acceptable Use

You agree not to use our services for any website or content that:

  • Is illegal, fraudulent, or violates any applicable laws or regulations
  • Promotes violence, discrimination, or hate speech
  • Contains malware, viruses, or other harmful code
  • Infringes on the intellectual property rights of any third party
  • Contains adult, pornographic, or sexually explicit material
  • Is misleading or deceptive to consumers
  • Facilitates spam or unsolicited communications

We reserve the right to refuse or terminate service for any client whose website content violates these acceptable use guidelines.

Service Availability and Uptime

We strive to maintain 99.9% uptime for all client websites. However, we do not guarantee uninterrupted service and are not liable for any downtime caused by:

  • Scheduled maintenance (we will provide reasonable advance notice)
  • Third-party hosting provider outages
  • Force majeure events (natural disasters, power outages, etc.)
  • Cyberattacks or security incidents beyond our reasonable control

Limitation of Liability

To the maximum extent permitted by law:

  • Austin Munday WebDev shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services.
  • Our total liability for any claim related to our services shall not exceed the total amount you have paid us in the three (3) months preceding the claim.
  • We are not responsible for any loss of business, revenue, or profits resulting from website downtime, design choices, or search engine performance.
  • We do not guarantee any specific results from SEO efforts, including search engine rankings or website traffic.

Indemnification

You agree to indemnify and hold harmless Austin Munday WebDev from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your breach of these Terms, your content, or your use of our services.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms. For significant changes, we will make reasonable efforts to notify active clients via email.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Orange County, Florida.
